1. Agreement to Terms

By downloading, installing, accessing, or using the Layer8Focus application (“Application”) and related web services operated by PEBCAK Consulting LLC (“Company”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, do not install or use the Application.

For users acquiring the Application via Apple’s App Store, this agreement also incorporates Apple’s Standard Licensed Application End User License Agreement (EULA), which governs your use of the Application on Apple-branded products.

2. License Grant & Restrictions

License Grant

PEBCAK Consulting LLC grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application on compatible devices that you own or control, strictly in accordance with these Terms.

Restrictions

You agree not to:

  • Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Application.
  • Modify, adapt, translate, or create derivative works from the Application.
  • Rent, lease, lend, sell, sublicense, distribute, or otherwise commercially exploit the Application.
  • Circumvent, disable, or tamper with any digital rights management, cryptographic security features, or license validation systems.
  • Use the Application for any unlawful purpose or in violation of any applicable local, national, or international regulations.

3. In-App Purchases & Billing

  • Pro Operator Lifetime License: Layer8Focus offers optional non-consumable in-app purchases (such as the Pro Operator Lifetime License) and optional tip contributions.
  • Payment Processing: All purchases made through the iOS, iPadOS, watchOS, macOS, or visionOS Application are processed directly by Apple through Apple StoreKit. Your payment is subject to Apple’s Media Services Terms and Conditions.
  • Restoration of Purchases: Non-consumable purchases can be restored at any time on devices associated with the same Apple ID using the Restore Purchases feature in the Application’s settings.
  • Refunds: Because transactions are processed by Apple, refund requests must be submitted directly to Apple in accordance with Apple’s refund policies (reportaproblem.apple.com).

4. User Data & Zero-Knowledge Architecture

  • Local Storage: Layer8Focus is architected as a local-first application. All focus telemetry, timer history, streaks, and preferences are encrypted at rest and stored directly on your local device.
  • Backup Archives (.l8bak): Users are responsible for safeguarding master passphrases used to encrypt .l8bak backup files. PEBCAK Consulting LLC does not retain copies of your private passphrases or unencrypted telemetry, and cannot recover data from password-protected archives if the passphrase is lost.

5. Health & Wellness Disclaimer

  • Layer8Focus provides interval timing, focus tracking, and mindfulness integration via Apple HealthKit and Android Health Connect.
  • The Application is intended solely as a productivity and general wellness utility. It does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before undertaking new wellness routines if you have underlying health concerns.

6. Intellectual Property

All visual designs, retro terminal interfaces, CRT styling, proprietary audio soundscapes, documentation, logos, and trademarks associated with Layer8Focus and PEBCAK Consulting LLC are the exclusive property of PEBCAK Consulting LLC and protected by applicable copyright, trademark, and intellectual property laws.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. PEBCAK CONSULTING LLC DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPLICATION WILL OPERATE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, IN NO EVENT SHALL PEBCAK CONSULTING LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE APPLICATION.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts and the United States, without regard to conflict of law principles.
